Please read these Terms of Service (“Terms”) carefully before using the Fit Arena application (the “Service”) operated by Kyun Labs (“us”, “we”, or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service & Accounts

Fit Arena is a gamified bodyweight fitness application. It uses your device’s camera to count push-up repetitions and turns them into a fantasy role-playing game featuring a campaign, boss battles, ranks, experience points, and additional workout modes.

Anonymous Usage: The Service does not require you to create a traditional account. We utilize anonymous identifiers (via Firebase) to provide the Service and save your progress. You may optionally sign in with Apple or Google to preserve progress across devices.
Fair Use: We reserve the right to impose limits on feature usage to ensure fair usage of our server resources.
Service Evolution: Game content, including chapters, enemies, ranks, achievements, and difficulty balancing, may be added, removed, or changed at any time.

2. Health, Fitness & Safety Disclaimer

Fit Arena is not a medical device and is not a substitute for professional medical or fitness advice. Physical exercise carries an inherent risk of injury.

Consult a Professional: Consult a physician before beginning this or any exercise program, particularly if you are pregnant, have a heart condition, a musculoskeletal injury, high blood pressure, or any other medical condition, or if you have been inactive for an extended period.
Assumption of Risk: You participate voluntarily and at your own risk. You are solely responsible for exercising within your own limits, using correct form, working out in a safe environment, and stopping immediately if you experience pain, dizziness, shortness of breath, or discomfort.
The Game Is Not a Coach: Enemies, boss health, rep targets, ranks, and difficulty scaling are game mechanics designed for entertainment. They are not medically-informed training prescriptions, and you should never push past your safe physical limits in order to defeat an enemy, complete a wave, or beat a timer.
Form Is Not Verified: The Service counts repetitions. It does not verify that your form is safe or correct, and it does not detect injury.
Minors: Users under 18 should have parental or guardian supervision before participating in any exercise program.

3. Camera Use & Rep Counting Accuracy

On-Device Processing: Rep counting uses on-device AI pose detection. Camera images are processed locally on your device and are never uploaded to our servers or shared with third parties. See our Privacy Policy for full details.
Accuracy Is Not Guaranteed: Automatic rep counting is an estimate. It may undercount or overcount depending on lighting, camera placement, clothing, body position, camera quality, and device performance. Kyun Labs makes no warranty as to the accuracy of rep counts, statistics, personal records, or ranks.
Physical Safety: Position your device so that it cannot fall on you or be knocked over. Ensure you have adequate clear floor space. Kyun Labs is not liable for damage to your device or injury resulting from device placement.
Optional: Camera access is optional. You may count repetitions manually instead.

4. Game Progress & In-App Assets

No Ownership or Cash Value: Ranks, levels, experience points, achievements, medals, stars, statistics, and other in-app progress are licensed to you for personal entertainment. They have no monetary value, cannot be sold or transferred, and are not redeemable for cash or anything of value.
No Guarantee of Preservation: While we take reasonable steps to sync and preserve your progress, we do not guarantee that progress data will never be lost, corrupted, or reset, whether by technical fault, account deletion, or discontinuation of the Service.
Anti-Cheat: We may adjust, reset, or revoke progress obtained through exploits, bugs, automated tools, or any means of artificially inflating rep counts.

5. Subscriptions & In-App Purchases

Fit Arena requires a paid subscription (“Fit Arena Pro”) to access its features. A one-time lifetime unlock may also be offered.

Billing: All payments are processed securely by the Apple App Store or Google Play Store. Kyun Labs never receives your payment method details.
Subscription Plans: Subscription pricing, features, and billing cycles are displayed within the app and may vary by region.
Auto-Renewal: Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.
Free Trials: If offered, free trials automatically convert to paid subscriptions unless cancelled before the trial period ends.
Refunds: All refund requests and subscription cancellations must be managed directly through your Apple or Google account settings. Kyun Labs cannot process direct refunds.
Price Changes: Kyun Labs reserves the right to change subscription pricing at any time. Existing subscribers will be notified of price changes before their next billing cycle.

6. User Conduct

By using Fit Arena, you agree NOT to:

Attempt to reverse engineer, decompile, or hack the Service.
Use automated scripts, bots, mechanical devices, or video playback to simulate reps.
Use the Service to harass, bully, or harm any person.
Circumvent any security measures, rate limits, or usage restrictions.
Exploit bugs, glitches, or vulnerabilities in the progression system, referral system, or any other feature.
Share, resell, or otherwise make your subscription available to other people.

7. Intellectual Property

Our IP: The Fit Arena brand, name, logo, interface, artwork, enemy and boss designs, characters, story text, game content, progression and rep-detection algorithms, and underlying code are the exclusive property of Kyun Labs.
Your Licence: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use.

8. Limitation of Liability & Indemnification

To the maximum extent permitted by law, Kyun Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

Any personal injury, physical harm, or health consequence arising from exercise performed while using the Service.
Your reliance on rep counts, statistics, ranks, difficulty scaling, or any other output of the Service.
Any loss of progress data, ranks, achievements, or other in-app assets.
Damage to your device, or property damage, arising from its placement during a workout.
Unauthorized access to your account or data.

You agree to indemnify and hold harmless Kyun Labs from any claims or damages arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Account Termination

Kyun Labs reserves the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to:

Violation of these Terms.
Cheating, or abuse of the progression or referral systems.
Use of the Service for unlawful purposes.
Any conduct that Kyun Labs determines, in its sole discretion, to be harmful to other users or the Service.

Upon termination, all progress data and account information may be permanently deleted.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes within the app. By continuing to use the Service after changes are posted, you agree to the updated terms.

13. Notice Regarding Apple & Google

Apple (iOS):If you are using Fit Arena on an iOS device, you acknowledge that these Terms are between you and Kyun Labs only, not with Apple. Apple is not responsible for the Service, its content, or any maintenance and support. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple for a refund of the purchase price. Apple has no other warranty obligation or liability regarding the Service. You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of the Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary thereof.

Google (Android): If you are using Fit Arena on an Android device, you acknowledge that these Terms are between you and Kyun Labs only, not with Google. Google is not responsible for the Service, its content, or any maintenance and support. Google has no obligation to provide warranty, support, or liability regarding the Service. You acknowledge that Google and its subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of the Terms, Google will have the right to enforce these Terms against you as a third-party beneficiary thereof.
